There is plenty being written about unfair bank charges, but the banks would have us believe that they are not unfair and they would dearly like to continue charging hefty fees to their customers. The legal battle taking place at the moment centres on the argument that it does not cost the bank £25, or even £35 when a customer goes overdrawn by a few pounds or makes a monthly payment a few days late or has a direct debit that fails to clear. |

Recent legal cases have found that the fees and charges imposed by banks, mortgage companies and credit card companies are unfair and do not reflect the true cost to the organisation of, for example going overdrawn. It is therefore possible to reclaim the unfair element of these fees and charges. When you consider what it actually costs the bank when you go slightly overdrawn or miss a payment by a couple of days it is clear that the fees they charge are inflated and not indicative of the actual cost they have incurred. So far there have been thousands of successful claims by consumers with some involving large sums of money - in excess of £30,000 successfully reclaimed. Of course the banks are none too happy about this and they are attempting to stop this tide of successful claims for unfair, and some would say illegal, bank charges. Consequently there is legal case taking place to determine whether these fees are deemed illegal, in which case the banks, mortgage companies and credit card companies will most likely face an awful lot of claims for charges and fees incurred. |
